Have no idea what h1b is, why not find another job? Less hassle

If you are in H1-B and not being paid, then technically you don’t have a job. If you don’t have a job, then you can’t stay in H1-B status. Filing the WH4 won’t necessarily get you the relief that you need. You might check the website http://www.shusterman.com to get some ideas about what you need to do, whom to contact, and how to proceed.
If you are being paid you do not indicate is it a weeks pay ? Two weeks ? Hiring a lawyer is very costly and they work to make money which means they will charge you lots of money to pursue this and this can run into thousands of dollars.
